The Blockchain Association of Kenya (BAK) has filed a petition challenging the legality of the Digital Asset Tax (DAT) introduced by the Kenyan government through the 2023 Finance Act. The DAT imposes a 3% tax on the transfer or exchange value of digital assets. BAK's legal and policy director stated that the petition aims to examine the legal and constitutional dimensions of this tax. Kenya is ranked second in Africa for crypto adoption, and the DAT has faced opposition due to unclear classifications of digital assets and concerns about unfair taxation. BAK plans to continue advocating for clarity in crypto regulations.
